5Feature-Specific Terms and Disclaimers
Family Court Toolbox contains numerous specialized features. The following terms apply to specific features:
5.1 AI Message Review
Family Court Toolbox may analyze user messages and communications using artificial intelligence to identify potentially hostile, threatening, inappropriate, or unsafe content.
- Purpose: AI message review is designed to protect user safety by flagging content that may violate our Acceptable Use Policy or pose a risk to other users.
- Not a Guarantee: AI review is a tool designed to assist platform moderation. It is not a guarantee that all inappropriate content will be detected or removed.
- Not a Substitute for Legal Protection: AI message review is not a substitute for restraining orders, court-issued protection orders, or legal remedies. If you are being threatened or harassed, please contact law enforcement or seek a restraining order through the courts.
- Not Legal Advice: Flagging of messages by AI does not constitute legal advice or legal interpretation.
5.2 Financial Calculators (Child Support, Legal Aid)
Family Court Toolbox provides various financial calculators for educational and planning purposes, including child support estimators and legal aid eligibility tools.
- Estimates, Not Advice: Calculators provide estimates based on general Canadian family law guidelines and tax rules. They do not constitute financial advice, legal advice, or professional accounting advice.
- Verification Required: You should verify all calculator results with qualified professionals, including:
- Licensed family lawyers regarding support obligations
- Certified financial planners regarding financial projections
- Chartered accountants regarding tax implications
- Provincial legal aid administrators regarding legal aid eligibility
- Variables and Assumptions: Calculators are based on general guidelines and standard assumptions. Your specific situation may involve variables, exceptions, or special circumstances not captured by the calculator.
- Jurisdiction and Updates: While calculators are based on Canadian guidelines, family law varies by province and is subject to regular updates. You are responsible for confirming that calculator assumptions reflect current law in your jurisdiction.
- No Liability: Family Court Toolbox is not liable for inaccurate results, decisions made based on calculator outputs, or financial consequences resulting from reliance on calculator estimates.
5.3 Family Vault and Document Notarization
The Family Vault feature allows users to store documents in the cloud. The "Digital Notarization" feature creates a cryptographic hash and notarization code for documents.
- Document Storage: Users are solely responsible for the accuracy, legality, and authenticity of documents they store in the Family Vault. Family Court Toolbox is not responsible for verifying document authenticity or ensuring documents comply with legal requirements.
- Digital Notarization Is Not Legal Notarization: The digital notarization feature creates a verifiable cryptographic code and timestamp for documents. This is NOT legal notarization and does not constitute a legally binding notarization in the eyes of courts or regulatory bodies. For documents requiring legal notarization, you must work with a licensed notary public.
- Evidentiary Value: Digital notarization codes and hashes may provide evidence that a document existed at a particular time and in its current form, but do not serve as legal authentication or verification of the document's contents.
- Data Loss and Backup: While we maintain industry-standard backups and security practices, Family Court Toolbox does not guarantee protection against data loss. Users are responsible for maintaining their own backups of critical documents.
- Access and Confidentiality: Users are responsible for controlling access to their documents and maintaining document confidentiality. Sharing documents through the platform exposes them to other users with whom you grant access.
5.4 Video Sessions
Family Court Toolbox provides a video conferencing feature for direct communication between users.
- User Responsibility: You are responsible for your conduct during video sessions, including your appearance, language, behavior, and the content you display or reference during calls.
- Recording Policies: All participants in a video session must consent to any recording of the session. Recording without consent of all participants is prohibited. Users who record video sessions are solely responsible for ensuring they have consent and comply with applicable privacy laws and provincial rules.
- Technical Tool Only: Family Court Toolbox provides the video technology and platform. We do not provide moderation, supervision, or oversight of video session conduct. You are solely responsible for managing your interactions.
- Third-Party Features: Video sessions may be powered by third-party technology providers. We are not liable for third-party service interruptions, security breaches, or technical failures.
5.5 Supervised Sessions (Parenting Time)
Family Court Toolbox facilitates the coordination of supervised parenting sessions but does not provide the actual supervision.
- Coordination vs. Supervision: The platform helps coordinate scheduled supervised parenting time and facilitates communication between users and designated supervisors. The actual supervision of parenting sessions is performed by independent professionals appointed by users or ordered by courts, not by Family Court Toolbox.
- Not Our Responsibility: Family Court Toolbox is not responsible for:
- The quality or competency of supervision provided by third-party supervisors
- The conduct of supervisors or their adherence to court orders
- Safety incidents or harm occurring during supervised sessions
- Enforcement of court-ordered supervision requirements
- Professional Qualifications: You are responsible for ensuring that any supervisor you appoint is qualified, vetted, and suitable for your situation. Family Court Toolbox does not vet or verify the qualifications of supervisors.
5.6 Parenting Coordinators
Family Court Toolbox provides a directory and coordination feature for parenting coordinators.
- Directory Service: Family Court Toolbox maintains a directory of available parenting coordinators for reference purposes. We do not endorse any particular coordinator and do not guarantee their qualifications or competency.
- Assignment and Coordination: Parenting coordinators assigned through the platform operate as independent professionals. Family Court Toolbox facilitates the assignment but does not employ, supervise, or control parenting coordinators.
- Advisory Nature of Decisions: Unless a parenting coordinator's decisions are specifically ordered by a court as binding, their recommendations and decisions are advisory only. You are not required to accept or follow a coordinator's recommendations unless formally ordered to do so by a judge.
- No Endorsement: Listing in our directory does not constitute an endorsement by Family Court Toolbox. The platform does not verify credentials, professional qualifications, or track records of listed coordinators.
- Third-Party Liability: Family Court Toolbox is not liable for the conduct, decisions, competency, or professional negligence of parenting coordinators, whether listed in our directory or assigned through the platform.
5.7 Anonymous Intake (Shelter Services)
Family Court Toolbox provides a specialized anonymous intake feature for shelter organizations serving domestic violence and crisis situations.
- Code-Based Access: Anonymous intake uses unique codes to provide secure, anonymous access without requiring email registration or identifying information. Codes are provided by shelter staff to individuals seeking services.
- Not a Crisis Service: Family Court Toolbox's anonymous intake feature is a support and documentation tool for shelter organizations, not a crisis hotline or emergency response service. If you are in immediate danger, call 911 or your local emergency services.
- Not a Substitute for Crisis Intervention: The platform is designed to assist shelter intake and documentation processes, not to replace crisis counseling, safety planning, or professional mental health services. If you are in crisis, please contact a crisis hotline or emergency services immediately.
- Limited Functionality: Anonymous intake provides basic information collection and intake documentation. It does not provide crisis counseling, emergency shelter booking, or immediate services.
5.8 Risk Assessments (Shelter)
Family Court Toolbox provides risk assessment tools designed for use by shelter workers and trained professionals.
- Tool for Professionals: Risk assessment tools are designed to assist trained shelter workers and professionals in assessing danger and risk. They are not clinical assessments and do not replace professional clinical evaluation by mental health professionals.
- Not a Clinical Assessment: Outputs from risk assessment tools should not be interpreted as clinical diagnoses or mental health assessments. These tools are designed to support professional judgment, not replace it.
- Supporting Tool Only: Risk assessments should be used as one of several tools in professional assessment, alongside interview, professional training, and professional judgment. The platform's output is an input to decision-making, not the final determination.
- Limitations: Risk assessment tools are based on research-supported factors but cannot predict with certainty individual behavior or outcomes. Risk assessment is probabilistic, not deterministic.
5.9 Teen Features
Family Court Toolbox includes specialized features for teenagers and minors, including preference collection and teen portal access.
- Parental Setup Required: Teen features require documented parental or legal guardian setup and authorization. Parents/guardians are responsible for monitoring teen access and usage.
- Age-Appropriate Design: Teen features are designed to be age-appropriate and accessible to younger users. However, parents/guardians retain responsibility for overseeing usage.
- Extra Data Protection: Data from minors is handled with additional privacy protections in accordance with child privacy laws and best practices. However, parents/guardians retain access to their minor child's account and data.
- No Direct Contact: Family Court Toolbox staff do not contact minors directly regarding their account or preferences without parental authorization. All communication regarding minors is directed to the responsible adult.
5.10 Legal Precedents and Expert Witness Directory
Family Court Toolbox maintains a database of legal precedents, case summaries, and expert witnesses for reference purposes.
- Reference Only: Legal precedent information is provided for educational and reference purposes only. It does not constitute legal advice or legal interpretation.
- Not Current Law: While we endeavor to keep precedent information current, legal interpretation and precedent evolve constantly. You should verify any cited precedent with a lawyer and confirm it reflects current law.
- Expert Witness Directory: The expert witness directory is a listing of available experts. Inclusion in the directory does not constitute an endorsement or verification of expertise. You are responsible for vetting any expert you hire.
- No Liability: Family Court Toolbox is not liable for inaccurate legal information, outdated precedent, or the qualifications or conduct of listed experts.
5.11 Cost Sharing Calculations
Family Court Toolbox provides cost-sharing calculation tools to assist in estimating expense division between parents.
- Calculation Tool Only: Cost-sharing calculations are estimates based on information you input. They do not constitute binding agreements or financial arrangements.
- Not Binding: Calculations assist with understanding potential cost-sharing scenarios but have no legal force unless both parties agree to incorporate the results into a formal agreement.
- Variables and Context: Actual cost-sharing arrangements depend on your specific circumstances, court orders, and negotiated agreements. Calculations do not account for individual circumstances or legal factors that may apply to your situation.
5.12 Court Filing Tracker
The Court Filing Tracker is a tool to help users track document filing status and deadlines.
- Tracking Tool Only: The filing tracker is designed to help you track your own filing progress. It is not a substitute for your lawyer's case management or court information systems.
- User Responsibility: You are responsible for meeting actual court filing deadlines. Court deadlines and requirements are determined by court rules and court orders, not by the filing tracker.
- Verification Required: Always verify filing deadlines with your lawyer or directly with the court. Do not rely solely on the filing tracker for deadline information.
- Court Information Systems: Family Court Toolbox's filing tracker is maintained independently of court information systems. Court filing status and deadline information is authoritative through the court, not through this platform.
